By participating in any event organized by 804 Race Events (hereinafter referred to as “804”), you agree to the following terms and conditions:
1. Assumption of Risk and Waiver of Liability:
As a participant at a 804 race event, I understand and acknowledge the inherent risks associated with motorsport activities, including but not limited to the risk of serious injury, death, and property damage. I understand that 804 undertakes no analysis of the safety or any other technical aspect of my vehicle, and therefore, bears no responsibility for any damage, injury, or death resulting from an accident involving my vehicle or myself as a passenger.
I acknowledge that participation in motorsport events carries inherent risks and that if I choose to participate, I do so voluntarily and at my own risk. I hereby waive any and all rights to make any claim whatsoever against 804, its staff, officers, or its agents for any loss or damage, including but not limited to injury, death, or property damage, arising from my participation in the event.
2. Participant Waiver:
In consideration of being permitted to enter any restricted area (including but not limited to the racing surface, pit areas, infield, burnout area, approach area, shut down area, and all walkways, concessions, and other areas appurtenant to any area where any activity related to the event shall take place), or being permitted to compete, officiate, observe, work for, or for any purpose participate in any way in the event, I, for myself, my personal representatives, heirs, and next of kin, acknowledge, agree, and represent that:
- I have inspected such restricted areas and all portions thereof which I enter and with which I come in contact, and I find and accept the same as being safe and reasonably suited for the purposes of my use.
- I assume full responsibility for and risk of bodily injury, death, or property damage due to the negligence of releases or otherwise while in or upon the restricted area and/or while participating in the event.
- I release, waive, discharge, and covenant not to sue the promoter, participants, racing association, sanctioning organization or any subdivision thereof, track operator, track owner, officials, vehicle owners, drivers, pit crews, any persons in any restricted area, promoters, sponsors, advertisers, owners, and lessees of premises used to conduct the event and each of them, their officers, and employees, from all liability for any loss or damage, and any claim or demands therefor on account of injury to my person or property or resulting in my death, whether caused by the negligence of the releasees or otherwise while I am in or upon the restricted area, and/or, competing, officiating in, observing, working for, or for any purpose participating in the event.
- I agree to indemnify and save and hold harmless the releasees and each of them from any loss, liability, damage, or cost they may incur due to my presence in or upon the restricted area or in any way participating in the event, whether caused by the negligence of the releasees or otherwise.
3. Safety Recommendations and Compliance:
I understand that any safety recommendations made by 804 are just that; recommendations. 804 does NOT enforce recommendations. I acknowledge that it is my responsibility to ensure that my vehicle meets all safety requirements and technical specifications for participation in the event. I understand that failure to comply with these requirements may result in disqualification from the event.
4. Insurance Requirement:
I understand that regular insurance policies may not cover the risks associated with motorsport events. I acknowledge that it is my responsibility to obtain motorsport-specific insurance coverage for myself and my vehicle.
5. Refund Policy:
804 event registration fees and spectator fees are non-refundable and may only be transferred if approved by 804. Due to the many investments and travel costs that go into planning 804 events, there will be no refunds for participant and/or spectator entry fees if the event has to be cancelled due to circumstances beyond our control, including but not limited to weather conditions. The event will not be rescheduled. In the event of adverse weather conditions, 804 reserves the right to suspend the event temporarily until it is safe to continue. No refunds will be issued for runs not completed due to weather-related interruptions.
6. Miscellaneous:
I acknowledge that 804 is not a sanctioning body with technical specifications or requirements for its racers’ vehicles. I am aware that there are many such sanctioning bodies, and if I need technical information about what such bodies recommend for their racers, I can contact such organizations for information.
I understand that 804 does not vouch for the driving skill or temperament of other participants and that I may choose to run solo to avoid the risks associated with unknown drivers. In any event, the risk of the race is mine alone and not that of 804.
I acknowledge that the activities of the event are dangerous and involve the risk of serious injury, death, and property damage. I agree that the foregoing release, waiver, and indemnity agreement are intended to be as broad and inclusive as is permitted by law and that if any portion thereof is held invalid, the remainder shall continue in full legal force and effect.
I have read and understood the terms and conditions outlined herein and voluntarily agree to be bound by them. I further agree that no oral representations, statements, or inducements apart from this written agreement have been made.
